Effective September 4, 2026

Terms & Conditions

Please read these terms carefully. They govern your account, purchases, digital credits, digital card collection, privacy, and use of the PokéPack service.

1. Acceptance and scope

These Terms & Conditions (the “Terms”) constitute a binding agreement between you and the operator of PokéPack concerning your access to and use of the PokéPack website, account, wallet, digital pack-opening experience, digital collection, and related services (collectively, the “Service”). By creating an account, purchasing PokéPack credits, opening a digital pack, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to these Terms and the Privacy Notice below.

If you do not agree to every provision of these Terms, do not access or use the Service. Additional terms presented by a payment processor or other service provider apply to the portions of the transaction that provider performs. In the event of a direct conflict, these Terms govern your relationship with PokéPack to the maximum extent permitted by applicable law.

2. Eligibility and account authority

You must be at least eighteen years of age, have legal capacity to contract, and be legally permitted to use the Service in your location. You represent that all registration and payment information you provide is accurate, current, and complete, and that you are authorized to use every payment method submitted through the Service.

You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account. You must promptly secure your account if you suspect unauthorized access. PokéPack may require reasonable verification, restrict access, or suspend transactions where fraud, abuse, unauthorized payment activity, legal risk, or a violation of these Terms is suspected.

3. Digital-only service

PokéPack provides digital entertainment products only. A digital pack opening grants in-Service digital card entitlements recorded to your PokéPack account. No purchase, opening, card image, displayed grade, collection entry, or other feature confers ownership of a physical trading card, a right to physical delivery, a cash account, a security, an investment, a deposit account, or an interest in any underlying intellectual property.

The Service does not provide cash withdrawal, payout, peer-to-peer transfer, external redemption, cryptocurrency conversion, or physical shipment. Digital cards and credits exist solely within the Service and may be used only through functionality PokéPack makes available from time to time.

4. PokéPack credits

PokéPack credits are a limited, personal, revocable, non-exclusive licence to access eligible digital products within the Service. Credits are not legal tender, money, electronic money, stored funds, property held in custody, or a cash-equivalent instrument. Credits have no cash value outside the Service and may not be sold, assigned, transferred, pledged, withdrawn, exchanged, or redeemed for money or anything outside the Service.

Dollar symbols and decimal amounts are used as a convenient purchase and pricing unit. They do not represent a promise that a balance is withdrawable or that PokéPack holds an equivalent amount for your benefit. Unless applicable law requires otherwise, credits may be used only by the account for which they were purchased or awarded and are not transferable between accounts.

5. Purchases and payment processing

Available credit top-ups are displayed before checkout. Payment information is collected and processed by Commas or another disclosed payment service provider; PokéPack does not receive complete card credentials. You authorize the processor to charge the selected amount, together with any taxes or charges disclosed at checkout, and authorize PokéPack to credit the corresponding in-Service balance after confirmed payment.

A checkout is not complete until the processor confirms successful payment and PokéPack records the corresponding credit transaction. Processing delays, authorization holds, declined payments, network failures, and processor review may delay delivery. You agree not to submit duplicate payments while a transaction is pending and to contact the applicable payment provider regarding card-processing issues.

6. Refunds, reversals, and chargebacks

Except where required by applicable law or expressly approved in writing, purchases are final after credits are delivered. Nothing in these Terms limits non-waivable consumer rights. If a payment is refunded, reversed, disputed, unauthorized, or charged back, PokéPack may reverse the associated credits and digital benefits, restrict further use, and suspend the affected account while the matter is investigated.

You remain responsible for transactions you authorized. Initiating an unfounded chargeback, using a payment method without authorization, or attempting to retain credits or digital products after a payment reversal constitutes misuse of the Service and may result in account termination and any other remedy available by law.

7. Randomized digital products

The contents of a digital pack are not known before opening and are selected from the applicable digital catalog through the Service’s randomized resolution process. Individual outcomes vary. Purchasing or opening a pack does not guarantee any particular card, rarity, grade, displayed value, collection outcome, or future availability.

You acknowledge that randomized pack opening is entertainment and must not be treated as an investment, income opportunity, savings product, or method of obtaining money or physical goods. Product composition, artwork, availability, pricing, and prospective catalog configuration may change, subject to applicable law and any description presented at the time of purchase.

8. Digital card values and sale-to-balance feature

Any value displayed beside a digital card is an illustrative in-Service reference used for PokéPack functionality. It is not an appraisal, market quotation, cash offer, representation of physical-card value, or promise of realizable value. External trading-card prices, if considered at all, may be delayed, incomplete, inaccurate, or unrelated to the digital entitlement recorded in your account.

Where PokéPack offers a sale-to-balance action, confirming the action permanently changes the selected digital card’s status and adds the amount shown to your in-Service credit balance. That transaction does not constitute a cash sale, payment, withdrawal, or acquisition of a physical card by PokéPack. Once confirmed, it may be irreversible except where applicable law requires otherwise.

9. Responsible use

You are responsible for setting and observing personal spending limits. Stop using the Service if pack opening ceases to be entertainment, interferes with financial obligations, or causes distress. PokéPack may introduce purchase limits, cooling-off periods, account restrictions, or other safeguards and may enforce them without creating an obligation to monitor every user’s circumstances.

10. Prohibited conduct

You may not use the Service unlawfully; evade geographic, age, account, or purchase restrictions; exploit bugs or timing conditions; interfere with payment or account records; automate transactions without authorization; reverse engineer protected portions of the Service; scrape or redistribute content at scale; impersonate another person; use stolen credentials or payment methods; launder funds; manipulate other users; or attempt to obtain credits, cards, or services without valid payment.

You may not sell, transfer, sublicense, or commercially exploit a PokéPack account, credit balance, or digital card entitlement. PokéPack may invalidate benefits obtained through fraud, technical abuse, duplicate fulfillment, or material error, provided that mandatory consumer rights remain unaffected.

11. Intellectual property and fan-project notice

The Service’s software, interface, branding, compilation, and original materials are protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no right or licence is granted to copy, modify, distribute, publicly display, sell, sublicense, or create derivative works from protected materials.

PokéPack is an unofficial digital fan experience and is not affiliated with, sponsored by, approved by, or endorsed by Nintendo, Game Freak, The Pokémon Company, or PackDraw. Pokémon names, characters, imagery, and related marks belong to their respective owners. References to third-party products or marks do not imply ownership, endorsement, or an official commercial relationship.

12. Availability, modifications, and account termination

The Service may be modified, interrupted, restricted, or discontinued for maintenance, security, legal, commercial, or technical reasons. PokéPack does not guarantee uninterrupted availability, permanent retention of any feature, or compatibility with any device or third-party service. We may suspend or terminate an account for material breach, fraud, abuse, legal necessity, security risk, or prolonged inactivity, subject to applicable law.

Upon termination, your licence to use the Service ends. Treatment of an unused credit balance will be governed by applicable law, the reason for termination, and any written policy presented at the time. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions—will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR ERROR-FREE OPERATION. POKÉPACK DOES NOT WARRANT THAT DISPLAYED VALUES, CATALOG INFORMATION, IMAGES, GRADES, DESCRIPTIONS, OR THIRD-PARTY INFORMATION ARE COMPLETE, CURRENT, OR ACCURATE.

Some jurisdictions do not permit exclusion of certain statutory warranties. In those jurisdictions, the exclusions above apply only to the extent legally permitted and do not affect rights that cannot lawfully be waived.

14. Limitation of liability and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKÉPACK AND ITS OPERATOR, AFFILIATES, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, OPPORTUNITIES, OR GOODWILL; OR LOSSES ARISING FROM UNAUTHORIZED ACCOUNT ACCESS, THIRD-PARTY SERVICES, OR SERVICE INTERRUPTION. AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO POKÉPACK DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR CAD $100, EXCEPT WHERE A DIFFERENT LIMIT IS REQUIRED BY LAW.

You agree to indemnify and hold harmless PokéPack and its operator from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Service, infringement of another person’s rights, payment fraud, or material breach of these Terms. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot lawfully be required.

15. Privacy notice

PokéPack processes account identifiers, contact information, authentication records, transaction references, wallet activity, pack-opening records, digital collection data, device and request information, and support or security communications as reasonably necessary to operate, secure, improve, and comply with legal obligations relating to the Service. Complete payment-card details are processed by the disclosed payment provider rather than stored by PokéPack.

Information may be disclosed to hosting, database, authentication, analytics, security, professional-adviser, and payment-service providers acting for legitimate operational purposes; to governmental or regulatory authorities where legally required; or in connection with a corporate transaction. Information is retained only for as long as reasonably necessary for the applicable operational, security, accounting, dispute, and legal purpose, subject to technical backup cycles and mandatory retention obligations.

Depending on your location, you may have rights to request access, correction, deletion, portability, restriction, or objection regarding personal information. Those rights may be subject to identity verification and lawful exceptions. Do not use the Service if you do not consent to the processing necessary to provide your account and transactions.

16. Governing law and disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Subject to any mandatory consumer forum or statutory right that cannot be waived, the courts located in British Columbia will have exclusive jurisdiction over disputes arising from the Service or these Terms.

Before commencing formal proceedings, each party agrees to make a good-faith attempt to resolve the dispute through written notice describing the claim and requested resolution. Nothing in this provision prevents either party from seeking urgent injunctive relief or using a consumer-protection process that applicable law makes available.

17. Changes, severability, and entire agreement

PokéPack may revise these Terms prospectively by publishing an updated version and changing the effective date. Material changes may also be communicated through the Service or to the email associated with your account. Continued use after the effective date constitutes acceptance where permitted by law; where additional consent is legally required, PokéPack will request it.

If a provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without prior written consent; PokéPack may assign them in connection with a reorganization, financing, or transfer of the Service. These Terms and incorporated notices constitute the entire agreement concerning the Service.

These Terms are a product disclosure and contractual document, not legal advice. The operator should obtain jurisdiction-specific legal review before expanding the Service or changing its purchase, randomized-content, credit, or redemption mechanics.
